Mr. Lothstein is an experienced DUI defense lawyer and criminal lawyer in New Hampshire whose victories have been widely reported in publications such as the Boston Globe, the Concord Monitor, the Nashua Telegraph, and the national Criminal Law Reporter. A former Assistant Appellate Defender and Public Defender, Mr. Lothstein has litigated over 80 appeals in the New Hampshire Supreme Court and U.S. Court of Appeals for the First Circuit.

His appeals have resulted in ground-breaking precedents, several of which have received national attention. Mr. Lothstein also handles complex post-conviction claims, such as a recent challenge to a first degree murder conviction brought in the Rockingham County Superior Courts.

As a Litigation Support Attorney with the New Hampshire Public Defender, Mr. Lothstein has taught seminars on the art and science of DWI defense to hundreds of New Hampshire lawyers, including CLE (Continuing Legal Education) programs sponsored by the New Hampshire Association of Criminal Defense Lawyers, the New Hampshire Bar Association, and Lorman Education Services (2006). As an Adjunct Professor at Plymouth State University, Mr. Lothstein taught the “Criminal Adjudication” course in the criminal justice department in 2011 and 2012. As an Adjunct Professor at St. Anselm College, Mr. Lothstein has taught courses in the criminal justice department in 2007 (Special Topics in Criminal Justice) and 2008 (Comparative Constitutional Law).

Mr. Lothstein clerked for Associate Justice (ret.) Robert Berdon, of the Connecticut Supreme Court, 1993-94. He went on to work as trial attorney, litigation support attorney, and assistant appellate defender at the New Hampshire Public Defender. In 2008, he opened his solo law practice, Lothstein Law Office, PLLC in Concord. He is a member of the New Hampshire Association of Criminal Defense Lawyers, National College of DUI Defense, and National and New Hampshire Ass’ns of Criminal Defense Lawyers.

Mr. Lothstein received his A.B. from Duke University and his J.D., summa cum laude, from the University of Connecticut School of Law.
